Coverage with Purpose

Medical Malpractice insurance is a crucial coverage for healthcare professionals.  It protects against accusations of negligence or inadequate treatment that result in patient injury in the following four ways:

  • Financial Protection: Malpractice claims can result in significant losses due to legal fees, settlements, and damages.
  • Legal Defense: Medical Malpractice insurance includes coverage for legal defense costs that are outside policy limits.  At times, the legal fees can be just as much as the award amounts.
  • Professional Reputation: Malpractice claims can be damaging to a healthcare provider’s reputation regardless of the outcome.  Having Malpractice insurance can mitigate the negative impact on a provider’s reputation.
  • License Protection: Medical Malpractice insurance is required for maintaining a professional license.  Failing to obtain and maintain insurance coverage can result in disciplinary action.

In addition to Medical Malpractice Insurance, Wilson Insurance can help you with your other lines of commercial coverage including Business Owner policies, Property, General Liability, Commercial Auto, Workers’ Compensation, EPLI, Employment Benefits Liability, Umbrella, and Data Breach and Cyber Liability coverage.

Key Coverage for Medical Malpractice

Claims-made policies only cover incidents reported on your active policy and that occurred after the policy’s retroactive date. If a claim is reported from an occurrence before your policy starts, your insurance company won’t provide coverage. You can buy this coverage back with prior acts coverage also known as ‘nose coverage’. Alternatively, if you want to extend the time a claim can be reported, you can purchase tail coverage.

The occurrence form simplifies coverage. It covers incidents that happen during a policy term regardless of when the claim is reported. Occurrence coverage provides coverage indefinitely.

Also known as an Extended Reporting Endorsement (ERE), tail coverage extends the amount of time a claim can be made against your policy after it expires or is canceled.

Colloquially known as ‘nose coverage’, Prior Acts Coverage is for liability from a prior claims-made policy that has been dropped and added to a new policy.

Supporting Coverage

BOPs are available for lower hazard operations and blend together property and liability coverages. They also provide direct and indirect blanket limits for miscellaneous coverages for a very reasonable price.

We can insure your building, business personal property, and business income for your practice.

In addition to professional liability exposures, your business has general liability exposures that require exposure as well. We can quickly help you find affordable coverage for your liability exposures

Medical offices face an increased EPLI exposure. You are four times more likely to be sued by your employee than have your building burn down. Your GL policy excludes EPLI coverage which requires you to buy it back on a separate policy. In addition to providing coverage limits, your EPLI policy will provide legal defense. Because medical offices handle sensitive, personal information in addition to financial details, they are frequent targets of cyber attacks. For more information about data breaches and cyber liability, check out our commercial lines coverage page.

Your workers are your most valuable asset. This coverage protects them against harm while they are on the job. For more information, check out our commercial lines coverage page.

Certain claims have the potential to pierce your underlying liability coverage. This coverage provides an extra layer of protection and legal defense. For more information, check out our commercial lines coverage page.

Common Questions and FAQs

Both forms offer advantages.  If you are on the fence about what form works best for you, we can talk you through the pros and cons.  We’d love to talk to you.

Nose coverage is also known as prior acts coverage.  It provides claims coverage for acts that occurred before the effective date of your policy for a previous policy that lapsed or was canceled.

The two types of malpractice insurance are claims-made and occurrence-based policies.

Most policies provide legal expenses outside policy limits. This protects your limits and prevents coverage erosion.  Your policy will articulate if defense costs are inside or outside your limit.

Some factors that influence your pricing are your coverage specialty, geographical location, and claims history.  For an articulate answer on what is affecting your premium, give us a call for a full coverage review.  We can break it down for you.

According to the National Law Review, causation is the hardest element to prove in malpractice suits.

According to John Hopkins Medicine, misdiagnosis is the ‘most common, most catastrophic, and most costly of all of medical mistakes’.

Negligence, misdiagnosis, medication errors, and failure to obtain informed consent are all common errors that lead to malpractice suits.  By focusing on these areas, you can decrease your risk and lower your insurance cost by showing favorable claim history.

The four elements of medical malpractice insurance can be summarized as a professional duty to patients, dereliction of your duty, injury caused by your breach of duty, and resulting damages.

According to the National Practitioner Data Bank, the average medical malpractice payout in Arizona across all practices was $351,570.

As reported by Forbes, 90% of malpractice claims are settled out of court.

The medical field is one of the top five industries for EPLI claims.  Because of this, we recommend having adequate limits and to not rely on sub limits provided on coverage extensions.
