What is an Experience Modification Rating (EMOD)?

An experience modification rating is sometimes referred to as an EMR, e-mod, or EMOD.  It is a factor that is awarded by the National Council on Compensation Insurance (NCCI).  Your EMOD awards or debits your manual workers’ compensation premium based on your 3-year claim history reported to the Industrial Commission of Arizona and your insurance company.  The better your claim history, the lower your EMOD.  The lower your EMOD, the lower your total cost of insurance is.

If you suspect an employee has committed fraud, let your insurance claim adjuster know.  Insurance companies have internal Special Investigative Units that research insurance fraud.  Additionally, you can file a fraud complaint with the Arizona Department of Insurance’s Fraud Unit.

If you are obtaining certificates of insurance for them, you don’t.  If you are not, then your 1099 subcontractors are uninsured and their WC liability flows upstream to you whether or not you list their payroll on your policy at not. The Industrial Commission of Arizona provides clarity on 1099 workers and WC coverage.

Yes!  In fact, sole-proprietors and partners are automatically excluded from WC coverage in Arizona.

Yes.  If your insurance agent used an incorrect class code that does not contemplate your business operations, auditors can readjust your policy so it is written correctly.  This may result in a change of premium.  

The first thing to do is ask.  If you feel your WC audit is incorrect, let us know so we can review your file.  Oftentimes WC disputes can be resolved quickly with clarifying information or a call to NCCI to verify the correct class code was used.

If you are a sole proprietor or single-member LLC, you are not required to carry WC insurance in Arizona per A.R.S. § 23-901 (et. seq.) and A.R.S. § 23-961(M).  If you are required to carry WC insurance as a COI condition and your vendor will not accept your signed WC waiver, some companies offer policies that provide WC coverage but exclude the sole proprietor or single-member LLC.  Yes, it is a $1,200 policy you can’t use.  But you can be in COI compliance with it.
